This behaviour is on a per-item name basis and not consistent amongst all other unique items. Divine orbs CANNOT make this item gain the modifier Summoned Skeleton Warriors are Permanent and Follow you, a behaviour consistent among legacy unique items. However, it may still be worth it to use a divine orb as even if it will not add the new modifier, it will improve the chaos resistance and movement speed modifiers to the new, higher rolls.
